Terms of service
These terms are the agreement between you and Xavier Jara, the publisher of VibeAR (Paris, France; details in the legal notice), for the use of VibeAR: the headset app, the desktop app, the website and the online services behind them (together, "the Service"). By creating an account, buying a plan or using the Service you accept them. How we handle personal data is in the privacy policy.
1. What VibeAR is
VibeAR shows the terminals, browsers, files and screen of your own computer as windows around you in a Meta Quest headset. It needs a compatible computer running the VibeAR desktop app on the same network as the headset. Some features (Cloud voice, AI skyboxes, collaboration) use our online services.
2. Your account
- You need an account to buy and activate a plan. Give a valid email address and keep your sign-in methods secure; you are responsible for what is done with your account.
- You must be at least 15, or have a parent's or guardian's permission.
- A plan can be active on up to two headsets at a time. You can free a seat yourself from the desktop app.
- You can delete your account at any time from the headset, the desktop app, vibear.dev/delete-account or by email. Deleting it cancels any subscription and ends access to anything bought on it.
3. Plans, prices and billing
- Monthly: a subscription billed every month in advance until you cancel. You can cancel at any time from "Manage billing" in the desktop app or on vibear.dev; access continues until the end of the month already paid, and nothing more is charged.
- Lifetime: a single payment for the VibeAR cockpit (see below for what "lifetime" means).
- Cloud voice orchestrator add-on: an optional monthly subscription on top of a cockpit purchase, which raises the monthly Cloud voice allowance. Cancellable the same way as Monthly.
- Prices are shown on vibear.dev before you pay, including any applicable VAT. Payments are processed by Stripe; we never see your card number.
- We may change prices for the future. A price change never affects a Lifetime purchase already made, and a subscription price change is announced by email at least 30 days ahead, so you can cancel before it applies.
- Cloud voice, AI skyboxes and the coding-assistant allowance carry usage limits per month or per week, shown in the apps. When a limit is reached, the feature pauses until the period resets; Local voice keeps working.
4. What "lifetime" means
A Lifetime purchase gives you the VibeAR cockpit, and the updates we publish for it, for as long as we offer VibeAR, without further payment. It is tied to your account, not to a person or a specific headset, and it covers two headsets at a time.
It does not include unlimited use of features that cost us per use: Cloud voice beyond the allowance that comes with every cockpit (the first three months are unmetered), and the AI skybox allowance, stay subject to the limits of section 3. It does not survive deleting your account, and it ends if the payment is refunded or reversed.
If we ever stop offering VibeAR, we will tell Lifetime holders at least 6 months in advance, and the apps on your devices will keep working for the features that do not depend on our online services. If that happens within 24 months of your purchase, we will refund a share of the price proportional to the part of those 24 months not yet used.
5. Your 14-day right of withdrawal
If you are a consumer in the European Union, you have 14 days from your purchase to withdraw from it, without giving any reason. To withdraw, email support@vibear.dev from the address on your account, or use the EU model withdrawal form, saying which purchase you are withdrawing from. We refund the full amount, by the same payment method, within 14 days of your request, and the plan is switched off.
We apply this to every purchase, Monthly, Lifetime and add-on, even though you start using the Service immediately. Outside those 14 days, payments are not refundable except where the law requires it, but a subscription can always be cancelled for the following periods.
6. AI features and their output
- Cloud voice uses Google Gemini and AI skyboxes use OpenAI; the privacy policy says what they receive. Local voice runs on your computer instead.
- AI output (what the voice assistant answers, explains or does, transcripts, generated images) is produced automatically and can be wrong, incomplete or inappropriate. Check it before you rely on it, and especially before you run a command, change a file or act on an explanation.
- The voice assistant acts on your computer only through the actions VibeAR offers (opening, moving and arranging windows, typing what you dictated). You remain responsible for what you ask it to do and for the commands run on your computer.
- As between you and us, you own what you put in and, to the extent the law allows, what the AI produces for you. You must not use AI features to produce content that breaks the law or the providers' usage policies.
- Coding assistants you run in a terminal (for example Claude Code or Codex) are third-party software used under your own account with their provider; their terms apply to them, not these.
7. Acceptable use
You agree not to:
- use the Service to break the law, or to infringe anyone's rights, privacy or intellectual property;
- access a computer, account or network you are not authorised to use, including through remote desktop, SSH or collaboration rooms;
- share, resell, or circumvent the licence, its two-headset limit, or the usage limits;
- reverse engineer, attack, overload or probe the online services beyond responsible security research (report vulnerabilities as described in the privacy policy);
- use AI features to generate illegal, sexual content involving minors, harassing, hateful or deceptive content, or anything prohibited by Google's or OpenAI's usage policies;
- use the headset in a way that endangers you or others; stay aware of your surroundings.
We may suspend or close an account that seriously or repeatedly breaks these rules, after telling you why when the law allows, and you may contest it by email. A closure for breach does not give rise to a refund beyond what the law requires.
8. Your content and our software
Your files, terminals, notes and everything on your computer stay yours; we do not claim any right over them. The VibeAR apps, website and brand are ours and are licensed to you, not sold: a personal, non-exclusive, non-transferable right to use them for as long as your plan is active (or for free features, as long as we offer them). Open-source components are under their own licences, listed in the apps.
9. Availability and changes
We work to keep the online services available but cannot promise they will never be interrupted. We may improve or change features; if a change removes something material you paid for, you may cancel and, for a purchase less than 24 months old, ask for a proportional refund.
10. Liability
Nothing in these terms limits your rights as a consumer under the law, including the legal guarantee of conformity for digital content and services (articles L.224-25-12 and following of the French Consumer Code). Within those limits, we are not liable for indirect losses, for the loss of data on your own devices (keep backups), for commands you run or ask the assistant to run, or for third-party services you use through VibeAR. Our total liability for a purchase is limited to the amount you paid for it in the previous 12 months, except for death or personal injury, fraud, or gross negligence.
11. Changes to these terms
We may update these terms. If a change matters, we email account holders at least 30 days before it applies. If you do not agree you can cancel and, for an unused prepaid period, get it refunded.
12. Disputes and applicable law
These terms are governed by French law. If you live in another EU country you keep the protection of its mandatory consumer law. Please contact support@vibear.dev first; we answer every complaint. If we cannot resolve it, you may use a consumer mediator free of charge, under articles L.611-1 and following of the French Consumer Code. Failing that, the competent French courts have jurisdiction, without prejudice to your right to go to the courts where you live.
